Parent / Guardian Waiver, Release of Liability & Assumption of Risk

At Kids Create Art & Wellness, we care deeply about creating a space where kids feel safe, supported, and free to explore their creativity and movement. This waiver helps us do just that. It outlines how our classes work, what to expect, and how we keep everyone protected.

Please read carefully. This is a legal document.

This Waiver and Release of Liability (the “Agreement”) is entered into by the undersigned parent or legal guardian (“Parent/Guardian”) on behalf of themselves and the minor child(ren) listed below (“Participant”), in favor of Kids Create Art & Wellness, its owner(s), instructors, contractors, volunteers, affiliates, and representatives (collectively, “KCAW”).

 

1. Program Description

Kids Create Art & Wellness offers creative art classes, process‑based art experiences, mindful movement, yoga‑inspired activities, breathing exercises, meditation, and related wellness programming for children and teens. Activities may include, but are not limited to, drawing, painting, sculpting, mixed media art, movement, stretching, balance poses, relaxation, and age‑appropriate mindfulness practices.

I understand that classes may be offered as:

  • Art‑only classes

  • Balance (mindful movement/yoga) classes

  • Combined Art + Balance classes (including transitions between activities)

 

2. Assumption of Risk

I understand and acknowledge that participation in art and wellness activities involves inherent risks, including but not limited to:

  • Physical injury from movement, stretching, balance activities, or accidental falls

  • Allergic reactions or sensitivities to art materials (including paint, clay, adhesives, fibers, or cleaning products)

  • Minor cuts, scrapes, or mess‑related accidents

I knowingly and voluntarily assume all risks, both known and unknown, associated with my child’s participation in Kids Create Art & Wellness programs.

 

3. Health & Medical Acknowledgment

I affirm that my child is physically and emotionally able to participate in the activities offered. I understand that Kids Create Art & Wellness instructors are not medical professionals and do not provide medical diagnosis, treatment, or therapy.

I agree to:

  • Inform KCAW of any relevant medical conditions, allergies, injuries, or special considerations prior to participation

  • Consult a qualified healthcare provider if I have any concerns about my child’s ability to participate

In the event of an emergency, I authorize KCAW to seek reasonable medical care for my child if I cannot be reached.

 

4. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless Kids Create Art & Wellness from any and all claims, demands, actions, or causes of action arising out of or related to my child’s participation in programs, including but not limited to claims for personal injury, illness, property damage, or emotional distress.

This release applies even if such claims arise from ordinary negligence, except where prohibited by law.

 

5. Indemnification

I agree to indemnify and hold harmless Kids Create Art & Wellness from any claims, liabilities, damages, or expenses (including attorney’s fees) arising from my child’s participation or from my breach of this Agreement.

 

6. Behavior & Participation Expectations

I understand that Kids Create Art & Wellness is a calm, respectful, and community‑centered environment. Participants are expected to follow studio guidelines and instructor direction to ensure safety for all.

KCAW reserves the right to remove a participant from an activity if behavior becomes unsafe or disruptive, without refund.

 

7. Photo, Video & Media Release (Optional but Encouraged)

I grant permission for Kids Create Art & Wellness to photograph or record my child during classes and events, and to use these images or recordings for educational, marketing, website, social media, or promotional purposes.

I understand that no compensation will be provided and that images may be used without identifying my child by name.

8. Studio Policies

I understand and agree that:

  • Missed classes, late arrivals, or early pickups do not guarantee make‑ups or refunds unless otherwise stated

  • Fees are non‑refundable unless explicitly outlined in written studio policy

  • KCAW reserves the right to modify schedules, instructors, or programming as needed

 

9. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Florida.

 

10. Acknowledgment & Signed during online registration process.

I have read and fully understand this Waiver and Release of Liability. I sign this Agreement freely and voluntarily on behalf of myself and my child.

This waiver is valid for the duration of my child’s participation in Kids Create Art & Wellness programs unless revoked in writing.
